The Arizona wrongful death statute says an action (a lawsuit) can be filed when a person’s death is caused by the “wrongful act, neglect or default” of another party and that act would have entitled the injured person to recover damages for injury if death had not occurred.
Who can recover damages for wrongful death?
​The spouse, child or children, and parent or guardian of a wrongful death victim may file a wrongful death lawsuit in Arizona. An action may also be brought by the representative of the person’s estate on behalf of the estate.
How much can you recover in an Arizona wrongful death action?
Article II § 31 of the Arizona State Constitution prohibits any state laws limiting the amount that can be recovered in a wrongful death action. When a case is taken to trial, Arizona law permits the jury to award damages it deems “fair and just” based on the injury to surviving parties and other relevant circumstances.
