The Arizona wrongful death statute says an action (a lawsuit) can be filed when a person’s death is caused by the “wrongful act, neglect or default” of another party and that act would have entitled the injured person to recover damages for injury if death had not occurred.

The spouse, child or children, and parent or guardian of a wrongful death victim may file a wrongful death lawsuit in Arizona. An action may also be brought by the representative of the person’s estate on behalf of the estate.

Article II § 31 of the Arizona State Constitution prohibits any state laws limiting the amount that can be recovered in a wrongful death action.
